*Exclusive* Banking Litigators INHERIT AN ENTIRE PRACTICE (succession) – Partner / Senior AssociateEmployer Location London (Greater) (GB) Salary up to £500,000 Closing date 18 Sep 2024View moreVacancy Type , Experience Level , , , Contract Hours Practice Areas , , PQE , ,Save jobClick to add the job to your shortlistYou need to or to save a job.Job DetailsSegal Placements is delighted to be exclusively representing a highly-regarded London based Firm who have a market leading Banking and Finance practice but who are looking to supplement it with an additional hire on the Banking Litigation side.The current head of that team is likely to be winding things down in relatively short order and a safe pair of hands is needed to look after the Firm’s long-established relationships on that side of things. As a result, within a couple of years the successful candidate will likely inherit an entire book of business (and potentially a ‘Head of’ role).The Firm is hugely connected with a wide array of lenders although less so with the large Retail banks and so the ideal candidate will more likely have relationships with Challenger banks, foreign lenders and short-term lenders (34 of whom this Firm is panelled with).Further, the successful candidate will likely have experience of at least some of the following:
- Advising lenders in connection with enforcement of loans, usually secured, and providing them with details of their available options.
- Reviewing security and loan paperwork and identifying any issues with these.
- Advising on remedies to address any issues with loan and/or security which are identified, if there are any available.
- Dealing with possession proceedings where required including contested actions and third party claims.
- Preparing witness statements, instructing Counsel and agents in respect of hearings.
- Advising on fraud cases and the implications for the lender and its security.
- Preparing for and attending mediations and other forms of alternative dispute resolution.
- Pursuing guarantors, both corporate and personal.
- Pursuing claims for negligence against valuers and solicitors.
- Liaising with the CPS regarding Restraint Orders and other orders under POCA and advising lenders on the implications on their enforcement.
- Advising receivers and administrators on matters related to security properties following their appointment (these can be very diverse).
- Negotiating and liaising with local authorities about planning breaches, amendments to S.106 agreements.
- Pursuing claims against the HMLR compensation scheme where the title is rectified as a result of fraud.
- Advising on whether loans should be regulated or unregulated and providing advice as to the relevant exemptions to the MCOB regulations.
- Liaising with High Court Enforcement Officers regarding enforcement in complex or contested cases.
- Advising clients on matters such as penalty clauses, allegations of unfair relationships and misrepresentation.
- Advising on claims of undue influence, usually from providers of third party security.
- Managing client relationships and providing monthly reports for some clients and attending quarterly governance meeting for others.
