Your new roleWhat you’ll do:The primary role of the Legal Counsel is to provide contentious and non-contentious legal support to the Executive Commercial Director [ECD], RCG Board and RCG group companies. The Legal Counsel will work with the RCG Preconstruction Director and preconstruction and commercial teams within the regional businesses to provide advice on all legal and contractual matters affecting the Group.

  • The Group Legal Counsel [GLC] will assist and advise on legal and contractual matters during preconstruction including input to GW2 through to GW4.
  • The GLC will review the draft contracts and prepare contract risk commentaries for all tenders in RCG using the RCG Reserved Matters schedule as the starting point. Where a contract is particularly complex, the GLC may recommend and obtain authorisation from the ECD and Robertson Group Head of Legal to use external legal resources off the approved list.
  • The GLC will assist the group businesses in negotiating an acceptable risk profile of all construction contracts and prepare and advice note for use by the project team in managing the contract.
  • The GLC will review all formal contracts prior to execution by RCG or any RCG business to ensure that they are in the correct agreed terms.
  • The GLC will ensure that all subcontracts, legal forms and notices in the Robertson Commercial Management system are kept up to date and will provide improvement proposals to the ECD for internal or external updates on a regular basis.
  • Where instructed by the ECD, the GLC will assist the RCG businesses in dealing with any contract or subcontract claims, adjudications or other legal processes, including helping to appoint and external legal advisors required, providing ‘risk notes’ on the issue and chances of success of a claim and meeting any external legal advisors.
  • Input where necessary to the GW processes for bids to ensure potential contractual gaps are identified. Implement GW7 lessons learned format and feedback to allow continuous improvement to be captured within RMS.
  • Where required by the ECD, attend Construction Board meetings and other Regional, Major Projects or Civils meetings.
  • Continuous Improvement – The commitment to continuous improvement should raise our standards of excellence in everything we do. The RCG CD should propose continuous improvement programmes to the RCG Board that ensure that the company remains at the forefront in the industry, applying the most cost-effective methods and approaches, provides leading-edge products and services to retain our competitive edge.
  • To provide legal and contractual advice and support to senior management of all businesses in the delivery of their business and growth strategy.
  • To undertake responsibility for delivery of any specific initiatives required to be undertaken as directed by the ECD.

What you’ll need:

  • Qualified solicitor – Scots Law essential and co-qualification in English Law preferred.
  • Substantial professional legal experience in a legal firm construction projects team
  • In-house legal experience with a construction business beneficial
  • Non-contentious experience essential, additional contentious preferred.
  • Relevant Masters degree beneficial but not essential
  • A track record of working with private and public-sector customers.
  • Wide experience of the construction marketplaces, including strategic development and dealing with customers.
  • An excellent knowledge of procurement processes for infrastructure and related services.
  • Experience in presenting and selling complex proposals to audiences at all levels of seniority.
