The successful candidate will support both regulated and unregulated businesses but with an emphasis on regulated businesses.Responsibilities
- Advising on regulatory and compliance matters arising in the many businesses in which the Fexco Group operates (predominantly in its regulated businesses), in particular bureau de change, payment services, asset finance and insurance intermediation.
- Supporting the relevant Fexco Group entities in meeting their obligations across the regulatory spectrum including in relation to AML/CTF, fitness and probity, minimum competency, outsourcing and consumer protection.
- Supporting businesses with regulatory correspondence and where necessary acting as point of contact for regulators (Irish and UK) in respect of material regulatory interactions.
- Supporting Fexco’s Group Governance team to achieve its goals of ensuring the highest levels of governance is maintained across Fexco’s businesses and identifying opportunities to standardise processes on a cross-business basis.
- Leading the Fexco Group’s horizon scanning work (Irish and UK) by proactively identifying new legal, regulatory and industry obligations which impact on or create new opportunities for Fexco Group, preparation of periodic updates to key stakeholders and supporting impacted Fexco businesses and local compliance teams.
- Supporting Fexco to explore new business opportunities by providing regulatory advice on new products and innovative services.
- Providing expert regulatory advice on contractual arrangements / corporate transactions where needed.
- Providing updates on regulatory matters to Fexco Group’s Executive Team and Fexco Group’s Risk & Compliance Committee as necessary.
- Supporting on the drafting/updating of compliance-related Group policies, including Fexco’s Group Compliance Framework and in the areas of Outsourcing, Lobbying, Fitness and Probity / Individual Accountability, AML/CFT and Anti-Bribery and Corruption.
- Preparing or supporting on applications for authorisation of new regulated businesses, advising on the application process and liaising with regulators as required (the Central Bank of Ireland, HMRC and the Financial Conduct Authority).
- Arranging (and where necessary, delivering) tailored training to relevant businesses and key stakeholders on a wide range of regulatory topics.
- Instructing and liaising with External Counsel in a cost-effective manner when required.
Qualifications and Key Competencies
- Qualified solicitor or barrister eligible to practice within Ireland.
- Ideally, 4 years’ relevant PQE in Irish and UK financial services regulatory matters (previous experience gained within a top tier law firm or a regulated financial services firm would be advantageous).
- Experience in AML/CTF, Fitness and Probity / Individual Accountability, Outsourcing and Consumer Protection and an understanding of the structure of both the Irish/UK domestic and European financial services legislation would also be a distinct advantage. Experience gained in a credit union environment may also be helpful in this role.
- While management experience is not necessary, the candidate may have a key role in directing the work of legal executive(s) / junior solicitors and supporting the work of compliance teams in each of the Group’s divisions.
- Ability to work in a fast-paced, frequently evolving and matrixed organization.
- Strong planning and organisational skills, with an ability to prioritise – experience in demonstrating use of initiative and being accountable for own workload.
- Excellent analytical, decision-making and administrative skills and strong academic qualifications.
- Excellent communication skills (both written and oral), with experience in presenting to peers, management and external partners.
- Possess a high degree of commercial awareness and experience of giving clear, practical advice and an ability to make sound and realistic decisions.
- A high level of motivation and an ability to act on one’s own initiative.
- Ability to work both autonomously and as part of multi-disciplinary teams with colleagues and external advisors, to cultivate strong relationships with business partners, and collaborate as a trusted advisor across the business.
- Familiarity with legal tech tools and solutions for enhancing efficiency and effectiveness an advantage.
