Offer DescriptionIn the framework of the DEMINAL project, we are looking for a full-time researcher with a masters / licence degree in law.ContextThe Royal Military Academy of Belgium (RMA) is a military institution responsible for the basic academic, military and physical training of future officers, and for the continuing advanced training of officers during their active career in the Belgian Defense department (Homepage | RMA). It is fully recognized as a university, fulfilling the same criteria as civilian universities. The Royal Military Academy is also conducting scientific research at university level for projects funded by the Belgian Defense department or external sources.This vacancy is part of a cooperation between the Chair of Law of the Department of Behavioral Sciences of the RMA and the Antwerp Health Law and Ethics Chair (AHLEC) of the University of Antwerp (UA). There will furthermore be close collaboration with Defence partners. You will conduct scientific research at university level on a project entitled DEfence Medics & (Inter)NAtional Law (DEMINAL), a principal aim of which is to prepare a double doctorate (RMA/UA) in this field. You will as such be a member of the international law team within the research unit Military Law at the RMA and become affiliated to AHLEC.StudyNational and international law require substantial consideration when facilitating health care services during a disruptive health crisis or in an Art. 3-5 NATO-Treaty context. However, both at the national and the international level there is at this moment a lack of sufficient and/or clear regulations to facilitate medical support in such scenarios. The objective of the DEMINAL project is to critically examine the (inter)national legal framework for medical operations/activities in case of possible crisis and/or art. 3 and 5 NATO-Treaty situations, and to offer policy support and substantiated proposals in case of gaps or when changes/updates are needed or advisory. Issues range from e.g. international agreements on clinical guidelines in resource constrained environments over the implications of battlefield conditions (large number of patients, prolonged care by embedded medics, …) to logistical aspects.Main TasksYou will conduct multifaceted research (focusing on international agreements, IHL, human rights, patient rights, data protection, procurement of pharmaceutical products, health surveillance obligations, medical professions regulations, etc.) into questions relating to, as well as (necessary) changes or additions to, the (inter)national legal framework applicable to medical operations/actions under Artt. 3 and 5 NATO-Treaty. This will include:

  • Providing policy and operations support research to prioritize and determine focal points and address specific acute questions.
  • Preparing (the first parts) of a PhD in social & military sciences/law at the RMA/University of Antwerp with supervisors at both universities, which entails conducting initial exploratory and even elaborative (more in-depth) doctoral research (identifying and selecting specific themes and questions for thorough critical analysis and commencing this scientific research).
  • Seeking and acquiring RMA-internal or external research funding (for further PhD research and/or related research projects).
  • Preparing (inter)national scientific publications & participating in conferences, seminars, etc.
  • Assisting in scientific and administrative duties (in limited amount).

  • Training or experience in (Belgian/European/international) medical law is required.
  • Training or experience in international law, in particular rules on peace & security and international humanitarian law, is highly recommended.

Specific RequirementsSpecific requirement

  • The researcher may be exposed to classified information and will therefore have to obtain the required security clearance. The candidate must consent with the background check required to obtain this clearance, which will be executed by Belgian Defense.
  • Working for the Patrimony requires living in Belgium for the duration of the study.

  • Probable date of recruitment: 1 October 2024, in consultation with the applicant.
  • Status: Full-time employment based on a long-term contract with the Patrimony of the Royal Military Academy (you will not be a civil servant).
  • NB: your contract will be open-ended, but the financing of the contract will be tied to the funding project, which is guaranteed for 18 months. There is a high chance for the project to be prolonged after this initial period, depending on the availability of new funding.
  • Wage scale: class A1 (holder of a Master’s degree in Science or equivalent). RMA-Patrimony applies a merit-based research career track, allowing researchers to advance in wage scale based upon annual evaluations.
